
'Female' hospitalized with injuries
James Smith was booked into the Volusia County Branch Jail early Thursday on aggravated rape charges.
NEW SMYRNA BEACH -- A 34-year-old man apprehended in Daytona Beach was arrested early this morning on rape charges involving violence on a female victim Wednesday night who had to be hospitalized for her injuries.
Police refused to release the victim's age so Headline Surfer is unable to inform the public if she is an older child or an adult. Florida statutes call for a charge of capital sex battery committed by an adult on a child under the age of 12. In this case, the accused, James L. Smith, was charged with sexual battery/aggravated battery,
Here is a synopsis of the 6 p.m. Wednesday incident in the 3600 block of Marisol Court as described by NSB police Sgt. Chris Kirk: "New Smyrna Beach Police, along with other assisting agencies, responded to the 3600 block of Marisol Court in reference to a sexual battery."
Kirk continued, "The victim was transported to Halifax Hospital and has been admitted due to her injuries. The suspect fled the scene prior to police arrival but was captured in Daytona Beach. The suspect was then transported to the New Smyrna Beach Police Department for processing and investigation and will be taken to the Volusia County Branch Jail without bond."
