Many conservatives like myself are thrilled with U.S. District Judge Roger Vinson declaring that the requirement that private citizens purchase health insurance is unconstitutional. The Florida-based federal judge went on to say that if forced purchase of health insurance was unconstitutional then the whole law was unconstitutional.
The judge pointed out that if the interstate commerce clause made forced purchase of health insurance constitutional then that clause could also be used to force individuals to buy broccoli since the shipment of broccoli also affects interstate commerce.
To most conservatives this ruling is long overdue since there is nothing in the constitution that allows the federal government to do anything in the field of delivering medical care.
A careful reading of the constitution reveals that if the central government is not explicitly given a power then that power is denied to the central government. Besides being unconstitutional, this law would have terrible consequences if enacted.
Briefly it would eventually destroy American Medicine as well as deteriorate our rights and freedoms. Even though this decision was a “no brainer” because of the blatant constitutional abuse of the law, Americans can no longer take anything for granted.
As time wears on our legal system has tolerated more and more outrageous abuses of our constitutional law. Anyway, this day at least we can be thankful for Judge Vinson and pray that his wise decision is upheld by the U.S. Supreme Court since the Obama Administration has already said it didn't agree with the judge.
