NSB man wanted on attempted murder charge in May shooting apprehended

NEW SMYRNA BEACH -- A 20-year-old New Smyrna Beach man was apprehended Thursday by Daytona Beach police and taken into custody without incident on outstanding warrants charging him with attempted murder in the shooting of a city resident in mid-May.

Here is a synopsis by police spokesman Sgt. Michael Brouillette of what happened On May 17:  "New Smyrna Beach Police received a report of a shooting in the 500 block of Josie St. The subsequent investigation revealed that Roy Deion Fudge shot Marcus Peterson during an altercation. Peterson sustained non-life threatening injuries. On May 19, 2009, arrest warrants were obtained for Roy Deion Fudge and police began actively searching for him. The warrants obtained charge Fudge with attempted second-degree murder and possession of a firearm by a convicted felon."

Fudge was transported to the Volusia County Branch Jail with bond set at $150,000.

The police bulletin for Fudge's apprehension stated: "Fudge is known to frequent New Smyrna Beach, Daytona Beach, Orange City and Deland. Do not attempt to detain Fudge -- he is considered armed and dangerous. Citizens should contact local law enforcement in any area where he is seen."

Peterson, 37, was shot at least once in a confrontation at 554 Josie St., about a block from Ronnoc Lane. Police did not release information on a possible motive for the shooting, though there was talk in the neighborhood of a drug deal gone bad.

Police responding to the 6:34 p.m. shooting, found the bleeding victim, police Sgt. Valerie Joyce said. He underwent surgery for a gunshot wound to his left shin at Bert Fish Medical Center.

Police have already made one arrest in the case. Jesse Lee McCoy, 26, was arrested at his residence the next day and charged with being a principal to attempted murder for allegedly giving the gun to Fudge, Joyce said.
